Terms & Conditions

Terms & Conditions

Welcome to Cotton Candy. By accessing our website, placing an order or purchasing from us, you agree to the following Terms & Conditions.

Orders & Personalisation

Many Cotton Candy products are personalised or custom-made specifically for each customer.

Customers are responsible for ensuring that all names, dates, spelling, wording, colours and other personalisation details supplied when ordering are correct. Cotton Candy cannot be held responsible for errors resulting from incorrect information supplied by the customer.

Once an order has entered production, changes may not be possible.

Product Appearance

As many of our products are handmade, personalised or individually produced, slight variations may occur between products.

Colours may also appear slightly different depending on screen settings, materials and product batches. These small variations are not considered defects.

Payment

Orders will only be confirmed once the required payment or deposit has been received.

Where a deposit is accepted, the remaining balance must be paid according to the agreed payment terms and before collection or dispatch unless otherwise arranged.

Production & Turnaround Times

Production times vary depending on the product, quantity, personalisation and current order volume.

If your order is required for a wedding, event or other specific date, please provide the correct event date when ordering. Urgent orders should be discussed with Cotton Candy before placing an order to confirm availability.

Cancellations, Returns & Refunds

Because many Cotton Candy products are personalised or custom-made, cancellations, returns and refunds may be restricted once production has begun.

Please refer to our Refund Policy for full details.

Nothing in these Terms & Conditions is intended to exclude or limit any rights you may have under applicable South African consumer law.

Shipping & Collection

Customers are responsible for providing accurate delivery and contact information.

Cotton Candy cannot be held responsible for courier delays or other delivery delays outside our reasonable control.

Please refer to our Shipping Policy for further information regarding processing, delivery and collection.

Damaged or Incorrect Items

If you receive an item that is damaged or does not match the details of your confirmed order, please contact Cotton Candy as soon as possible and provide clear photographs of the product and packaging so that we can assess the matter and assist you.

Unless otherwise stated, photographs, product designs, graphics, website content and other original material displayed on the Cotton Candy website and social media platforms remain the property of Cotton Candy and may not be copied, reproduced or used for commercial purposes without permission.

Terms & Conditions - the basics

Having said that, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you, as the owner of this website. The T&C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T&C are meant to establish the legal relationship between the site visitors and you as the website owner.

T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).

T&C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.

What to include in the T&C document

Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
